Terms of Service

These are the standard terms and conditions for any design project undertaken by me. Please review carefully before we begin working together. If you have concerns about any provisions, contact me prior to project commencement so we can discuss modifications specific to your needs.

Payment Terms

I typically request a 50% deposit before starting your project, with the remaining balance due before final files are delivered. Payment is expected within 30 days of invoicing. By paying the deposit, you're agreeing to these terms and we're officially working together.

If we lose touch for more than 30 days, I may need to invoice early to wrap things up. Payment plans are available—just ask and we can work something out in writing.

For overdue accounts beyond 30 days, I may need to charge any collection fees incurred.

Brand Name & Trademark

You're responsible for ensuring your business or product name is legally available and safe to use before we begin.

Trademark registration, copyright filing, and comprehensive name searches involve complex and expensive legal processes that fall outside my scope of service. If you want to register your logo as a trademark, you'll need to work with a qualified attorney who specializes in intellectual property law.

I can't offer refunds or assume liability if legal issues arise with your name after the project is complete.

If you need to change your business name mid-project after I've already presented design concepts, we'll need to discuss additional costs. A name change essentially means redesigning from the beginning, so please do your legal homework before we start.

Fonts & Typefaces

Font licensing works a bit like music licensing—each user needs their own license to use fonts commercially. When I present concepts, I'll share where fonts can be purchased, and you'll need to get your own licenses for any you want to use beyond the logo itself.

I can't legally share copies of fonts I've purchased, but I'm happy to point you in the right direction. Logo files with fonts converted to shapes don't require licensing, but if you need the actual font for editing purposes, you'll need your own license.

Cancellation

Life happens. If you need to cancel mid-project after I've already presented work, I can't refund what's been paid, though we might work out a partial refund depending on how far we've gotten.

If I become unable to complete your project due to illness or emergency, I'll refund most or all of your payment, depending on what's been completed and whether another designer could use the work.

I reserve the right to pause or end a project if things become unworkable—excessive revisions beyond what's reasonable, payment issues, or breakdown in communication. I'll always give you notice and a chance to get things back on track first.

Ownership & Copyright

All the sketches, unused concepts, and exploration work I create during our project remain mine. This lets me learn from each project and occasionally repurpose ideas for future work (with enough changes to avoid any conflicts).

The final approved design becomes yours once you've paid in full. Until then, everything stays with me.

I'd love to feature your completed project in my portfolio and share it on social media or in publications. If you need confidentiality or have timing concerns, just let me know upfront.

Important Disclaimers

I create original work and run basic checks to ensure nothing unintentionally resembles existing designs. However, you're responsible for doing your own thorough trademark and plagiarism checks. I can't be held liable for legal issues that arise from trademark conflicts or other intellectual property concerns.

You can modify the final design however you'd like once it's yours, but any changes are at your own risk.

I'm not responsible for losses or damages related to the use of my services or any materials I create, to the fullest extent allowed by law. This includes any third-party content or external links.

If something beyond my control—natural disasters, government action, or other force majeure events—prevents me from completing work, I won't be in breach of contract. I'll let you know what's happening and resume work as soon as possible.
